Your business faces liabilities every day and as society evolves and grows so do your liability exposures. One way to protect your business assets is to carry adequate, quality, primary Commercial General Liability (CGL) insurance. General Liability insurance covers claims of bodily injury or other physical injury or property damage that are caused by negligence from a range of exposures as well as provides legal defense coverage to respond from lawsuits against your business. Morris & Reynolds offers General Liability insurance from the world’s leading insurers and offers this coverage for any and every business type imaginable.

Slips and falls, assault, battery, murder, bad things sometimes happen. It may be difficult to imagine how your business could cause another person serious harm or even death. But it’s good to know that if you are ever held responsible for someone else’s sickness, injury, or disease, your general liability insurance policy would pay the injured person for a range of things, some of which include medical care costs, loss of services and for court-awarded compensation.

Even if you’re careful and take precautions, it’s still possible that something your business does – or something it doesn’t do – could damage another person’s property. It’s also possible that your actions might prevent the property’s owner from being able to use it. In such cases, your business liability insurance coverage can pay the owner of the property your business damaged a number of things including physical damage to the property and loss of use of the property. It is helpful to know that property damage liability coverage often does not cover damage caused to client property you are working on or have in your possession.

If you make, distribute or service something you need Commercial General Liability insurance and its Products & Completed Operations coverage. Commercial general liability insurance policies generally include liability protection related to negligence for services you render and the products you sell from your company. So if something your company manufactures, distributes or a service that your business provides causes an injury, your policy would pay for any resulting legal expenses, as well as damages up to your policy’s limit. It is helpful to know that professional services, such as creating a drawing, providing legal advice or a medical service such on you might find from an architect, lawyer or doctor is not covered by general liability policies.

Most commercial liability insurance policies cover liability you might take on when you enter into various contracts, such as easement-of-license agreements, building leases, elevator maintenance agreements and agreements to indemnify a municipality, if required by ordinance.

If you do not manufacture, distribute, sell, serve, or furnish alcoholic beverages as a business, your general liability insurance policy will cover you if are held liable for a liquor-related accident from what is called host liquor liability. If you distribute alcoholic beverages occasionally, such as at a company picnic or office holiday party, you’d also be covered – as long as you don’t charge money for the alcohol. For businesses such as a restaurant, lounge or beverage distributor Morris & Reynolds can arrange Liquor Liability coverage for your business.

If your business rents a vehicle or might then it needs to have Hired Auto Liability. For those occasions when someone drives their own vehicle for a business errand, say to the bank or a supply store, your business needs Non Owned Auto Liability. If these coverage’s are not added to your business auto policy then many Commercial General Liability insurers will add them to their coverage for a minimal cost.

RENTAL CARS: This coverage also allows you to save money on at least part of the insurance that rental car companies recommend whenever you pick up their cars. When you rent the car in your company’s name, this insurance applies to the liability part of the rental car contract. You’ll still need to purchase damage insurance from the car rental agency if you want to be fully protected, however, as this option doesn’t cover physical damage to the rented vehicle.

NON-OWNED AUTO’S: If you or an employee is driving a personally owned vehicle on company business, and you have an auto accident, non-owned auto coverage protects you should the company be sued. However, the policy will not cover a suit against you or your employee personally – that would be covered by a personal auto policy.

Personal injury is the part of the commercial general liability policy that protects you should someone claim that your business caused them damage from libel, slander and defamation. Personal Injury Liability often addresses claims businesses might face from; publishing, in writing or verbally, false information that libels or slanders an organization or person; publishing material that violates someone’s privacy rights, falsely detaining, arresting or imprisoning someone and maliciously prosecuting someone or evicting someone wrongfully.

Should you ever be sued over something that happens while advertising your company’s products or services, your business liability insurance protection’s Advertising Injury can help. Advertising injuries can arise from a range of exposures including; your business publishing, verbally or in writing, false information that libels or slanders a person or organization; publishing material that violates an individual’s privacy rights; copying another company’s style of doing business, or advertising concepts and infringing on another business’s title, copyright or slogan

Medical Payments can be viewed as ‘good will’ insurance and can be used by the insurer to try and pay for a small claim so as to avoid litigation. If a person should be injured, either directly by you or at your place of business, your commercial liability insurance coverage would pay for funeral and medical expenses. For example, if one of your clients slips and falls at your office and requires medical treatment, your policy would cover the cost of that treatment up to the limit shown in the policy.

The cost to defend your business once a lawsuit arrives can be astronomical. Many businesses value the coverage their liability insurance provides not because they expect a claim or to have damages to be paid for negligence but for the defense costs the insurance includes in the event someone sues them. A Commercial General Liability policy typically provides unlimited defense costs is you are sued and will generally pay for:

  • Costs to defend or investigate a suit or claim against you, including court costs, witness fees, attorney’s fees, and police report costs
  • Reasonable expenses, such as the loss of your income for a day in court
  • Judgments or settlements resulting from covered suits, including interest required on the judgment and the injured party’s medical expenses, if your defense is unsuccessful
  • Court bonds to ensure you can pay a potential judgment in a liability suit, this insurance will pay the premium for the bond

General Liability insurance does not protect your business against every liability. If you or your employees make professional judgments and recommendations in the course of your business Morris & Reynolds can help you obtain a Professional Liability policy in addition to a Commercial General Liability policy. Professional Liability Insurance (also known as Malpractice, or Errors and Omissions, or E&O coverage) is a separate type of insurance that protects your business against loss from a claim of alleged negligent acts, errors or omissions in the performance of your professional services. Professional Liability insurance is another important type of coverage to protect your business from potentially catastrophic claims.
